Terms of Service

These terms are an agreement between you and The Dean of Big Data LLC, a North Carolina limited liability company ("The Dean of Big Data", "we", "us"). They govern your use of OkComputer: the desktop application, the website, and the subscription service behind them (together, the "Service"). By creating an account or using the Service, you agree to these terms.

1. The Service

OkComputer is a desktop AI workspace for Windows. A subscription provides AI actions that the built-in engine spends when it sends requests to AI model providers through our servers. The application can also connect to engines you subscribe to separately, such as Codex and Grok, which run on your own accounts with those providers and do not use our servers or your AI actions.

2. Your account

You must be at least 18 years old to create an account. You agree to provide accurate information, to keep your password secure, and to tell us promptly if you believe your account has been compromised. You are responsible for activity that happens under your account.

3. Plans, AI actions, and billing

The Free plan costs nothing and includes 100 AI actions per month. Paid plans bill monthly through Stripe, our payment processor, at the price shown at checkout. Each billing period your account is granted the number of AI actions included in your plan. AI actions are consumed as you use the built-in engine, at rates that vary with the model you select. AI action pricing includes a margin over the underlying model-provider cost to cover payment processing and the cost of operating the service. Unused AI actions do not carry over: your balance resets to the plan amount at the start of each new period. AI actions have no cash value and cannot be transferred or redeemed. Some features, such as the external engine integrations, may be limited to particular plans; the current plan lineup is shown in the application.

$OKCO holder pricing. $OKCO is an ecosystem token on the Solana network. Holding $OKCO in a qualifying wallet may reduce the price of, or change the AI action allowance on, certain plans based on the tier thresholds published on the pricing page. Holder benefits are product discounts and allowances only. $OKCO is not an investment vehicle, we do not offer staking, locking, revenue sharing, or any promise of returns, and nothing on our site is financial advice. Benefits require no staking and no lockups; they follow your wallet balance as displayed on the pricing page.

Automatic renewal. Paid subscriptions automatically renew. At the start of each billing period, the payment method on file is charged the then-current price for your plan, and this continues until you cancel. There is no separate renewal action required from you. You may cancel at any time as described in Section 4, and cancelling stops future renewals. If we change a plan's price, we will give you notice before the change applies to your next billing period.

4. Cancellation and refunds

You can cancel your subscription at any time from the application's billing settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where the law requires otherwise, payments already made are not refunded and partial periods are not prorated. If you believe you were charged in error, contact us and we will look into it.

If you are a consumer in the European Union or the United Kingdom, you may have a statutory right to withdraw from a purchase within 14 days. Where that right applies, we honor it; note that by starting to use a paid plan immediately you may be asked to acknowledge that the service begins during the withdrawal period.

6. Third-party engines and services

Connecting OkComputer to Codex, Grok, or other third-party engines uses your own agreement with each provider. Those engines run under your separate accounts, and your use of them is governed by the provider's own terms and policies. We do not control third-party services and are not responsible for them.

7. Your content and your computer

You own the content you create with OkComputer. By default, your conversations, memory notes, library documents, and workflows are stored on your computer rather than on our servers. Optional cloud features, such as Automations, store the documents and results you choose to place in the cloud on our servers, encrypted at rest, as described in our Privacy Policy. When you use the built-in engine, your prompts and relevant context pass through our servers only as needed to obtain a response from the model provider, as described in our Privacy Policy. The model providers reached through our routing provider process your prompts and the resulting output under their own terms and privacy policies, which for some models may include retaining that content or using it to improve or train their models. Our Privacy Policy explains this and how to choose models accordingly.

You are responsible for ensuring you have the right to submit the content you send through the Service and for not submitting content whose disclosure to these third-party model providers would violate any obligation you owe to others (for example, confidentiality obligations or applicable data-protection requirements).

If you submit a bug report from within the application, it is sent to our error-reporting provider and, unless you opt out in the report form, includes the conversation you are reporting on and your account email so we can reproduce and fix the problem. Automatic crash reports never include conversation content. See our Privacy Policy for details.

OkComputer runs AI agents on your machine that can read and write files, run commands, and take other actions in the folders you point them at. You direct what the agents do and you are responsible for the instructions you give them. We recommend keeping backups of important data and pointing agents at folders you are comfortable having them work in.

8. AI output

AI-generated output can be inaccurate, incomplete, or out of date, and the same prompt can produce different answers. You are responsible for reviewing output before relying on it or sharing it. The Service does not provide legal, medical, financial, or other professional advice.

9. License and ownership

We grant you a limited, non-exclusive, non-transferable license to install and use the OkComputer application for your own use while these terms are in effect. We and our licensors retain all rights in the Service, including its software, design, and branding. If you send us feedback or suggestions, you allow us to use them without obligation to you.

10. Updates and availability

The application checks for and installs updates automatically. We may add, change, or remove features over time. We work to keep the Service available but do not guarantee uninterrupted operation, and the Service depends in part on third-party providers we do not control.

11. Termination

You can stop using the Service at any time and can delete your account from the application's settings. We may suspend or terminate your access if you materially breach these terms, if required by law, or if we discontinue the Service, in which case we will give reasonable notice where practical. Sections of these terms that by their nature should survive termination do survive, including ownership, disclaimers, and limitations of liability.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT AI OUTPUT WILL BE ACCURATE OR RELIABLE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEE THROUGH TECHNOLOGIES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR FIFTY DOLLARS IF YOU HAVE PAID US NOTHING. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless The Dean of Big Data LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service in violation of these terms, or your violation of law or the rights of a third party.

15. Changes to these terms

We may update these terms from time to time. If a change is material, we will give notice through the website, the application, or email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated terms.

16. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Disputes that cannot be resolved informally will be brought in the state or federal courts located in North Carolina, and both parties consent to their jurisdiction.
